All orders and any subsequent purchase of Goods (as defined below) or services from shall be governed by the following terms and conditions. Please read them carefully.

The Optic Shop and its affiliates or assigns provide the website located at The Optic Shop and any associated parts, sections or services to you subject to certain conditions. By visiting this site you accept these conditions. Please read them carefully. In addition when you use any current or future part section or service of The Optic Shop or purchase from any business affiliated with it, you also will be subject to the guidelines and conditions applicable to such service or business.

All use of the site and any orders or subsequent purchase of goods or services (as defined below) from The Optic Shop shall be governed by the following terms and conditions.

Terms of Use

Licence and Site Access

The Optic Shop grants you a limited licence to access and make personal use of this site and not to download (other than page caching) or modify any portion of it except with express consent of The Optic Shop. This licence does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining robots or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without express written consent of The Optic Shop. You may not frame or utilise framing techniques to enclose any trademark, logo or other proprietary information (including images text page layout or form) of The Optic Shop and our affiliates without express consent. You may not use any meta tags or any other “hidden text” utilising The Optic Shop’s name or trademarks without the express written consent of The Optic Shop. Any unauthorised use terminates the permission or licence granted by The Optic Shop. You are granted a limited, revocable and nonexclusive right to create a hyperlink to the home page of The Optic Shop so long as the link does not portray its affiliates or their products or services in a false, misleading, derogatory or otherwise offensive matter.

General Disclaimer of Warranties and Limitation of Liability

The Optic Shop and its sections, parts and services are provided by on an “as is” and “as available” basis and The Optic Shop makes no representations or warranties of any kind express or implied as to the operation of this site or the information, content, materials or products included on this site. You expressly agree that your use of this site is at your sole risk. Notwithstanding product warranties referred to in the Terms of Sale to the full extent permissible by applicable law The Optic Shop disclaims all warranties express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Due to the inherent nature of the Internet The Optic Shop does not warrant that this site, its servers or e-mails sent from it are free of viruses or other harmful components and The Optic Shop will not be liable for any damages of any kind arising from the use of this site including but not limited to direct, indirect, incidental, punitive and consequential damages.

Applicable Law

Notwithstanding the Terms of Sale and Supply of Goods below by visiting The Optic Shop you agree that the laws of the United Kingdom without regard to principles of conflict of laws will govern these Conditions of Use and any dispute of any sort that might arise between you and The Optic Shop or its affiliates.

Disputes

Any dispute relating in any way to your visit to The Optic Shop or any of its parts, sections or services shall be submitted to confidential arbitration except that to the extent you have in any manner violated or threatened to violate The Optic Shop intellectual property rights may seek injunctive or other appropriate relief in any UK court. No arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement whether through class arbitration proceedings or otherwise.

Site Policies Modification and Severability

Please review our other policies posted on this site. These policies also govern your visit to all services provided by The Optic Shop. We reserve the right to make changes to our site policies and all associated Terms at any time. If any of these conditions shall be deemed invalid, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

Electronic Communications

When you visit The Optic Shop or send e-mails to us you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Copyright Complaints

The Optic Shop and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement email us with your complaint.

Terms of Sale

The Optic Shop is the trading name for THE OPTIC SHOP LIMITED trading on the internet at The Optic Shop

“We” / “Us” / “Our” refers to “You” / “Yours” refers to the Customer.

Format of the Contract

These terms of sale apply to all products, services or merchandise (hereinafter known as “goods”) or other saleable items specifically supplied by The Optic Shop.No contract exists between you and us for the sale of any goods until we have received and accepted your order. An acceptance of your offer to buy the goods will be sent shortly after your order. However we do reserve the right to terminate the contract in the event that the goods are unavailable, mis-priced or cleared funds are not received. The contract is subject to your right of cancellation (see below). We may change these terms of sale without notice to you in relation to future sales. However such changes to these terms and conditions will be posted to our website.

Jurisdiction

These terms of sale and the supply of the goods will be subject to the laws of England and Wales and English/Welsh courts will have jurisdiction in respect of any dispute arising from the contract save that consumers resident in Scotland shall have the right to insist upon these terms being construed in accordance with the laws of Scotland and to submit to the jurisdiction of Scottish courts.

Customer Obligations

By submitting your order you confirm:

  • You are aged 16 or over and are not registered blind or partially sighted;
  • You are in possession of a valid written prescription for your spectacles that has been given to you by a suitably qualified person that does not exceed it's recall date; and
  • You will supply accurate details of your current prescription (including any notes on the prescription) when requested.

Orders for Goods

Orders to must be submitted either via the web at The Optic Shop.

Submission of an order represents an offer to purchase goods from The Optic Shop and we may confirm receipt of this offer via e-mail (if the order is placed via the site).

Prescription glasses orders are only accepted by us once your payment has been processed and they have been reviewed and authorised by a qualified Optician. In the case of the non prescription goods your order is accepted once the required payment has been accepted or when the relevant goods are shipped whichever occurs first. We will confirm acceptance of your order via e-mail or verbally.

Product Images

Product images are for illustrative purposes only and may differ from the actual product.

Limitations of Supply

We will make a reasonable effort to ensure that all orders are fulfilled; however we cannot guarantee the availability of goods. If the goods you have ordered are unavailable we will attempt to contact you to give you a choice to receive an alternative or a refund. If we are unable to contact you your order will be cancelled and you will be given a full refund. On the advice of our qualified Opticians we have absolute discretion as to whether or not to accept your order.

If considered necessary or appropriate before an order is accepted The Optic Shop qualified Opticians have absolute discretion:

  • to contact you to discuss your order, provide advice and/or arrange a free face-to-face consultation with you;
  • to request that you send us a copy of your written prescription;
  • to contact directly or request that you contact the optician who provided your prescription to verify and/or discuss your prescription;
  • to request that you obtain your pupillary distance measurement from your optician; or
  • to request that you obtain a new written prescription from your optician.

Description and Price of Goods

The description and price of the goods you order will be as shown on our website at the time you place your order.

Prices stated at checkout are inclusive of any Value Added Tax (VAT) that may be required to be remitted to tax authorities by The Optic Shop. VAT  will be clearly marked and itemised.

The goods are subject to availability. If on receipt of your order it is deemed that the goods you have ordered will not become available in a reasonable time we will not accept your order. If after acceptance or job order we discover within [14 days] of our acceptance of your order that the goods are unavailable we reserve the right to terminate the contract and refund or re-credit you for any sum that has been paid by you or debited from your credit or debit card for the goods.

The Optic Shop prices are exclusive to internet sales and although part of the Group retail sales from the outlets are subject to a minimum additional £20.00 service / fitting fee.

Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found within 14 days of accepting your order we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If we do not receive an order confirmation within 14 days of informing you of the error the order will be cancelled automatically. If you cancel the order or if the order is cancelled automatically due to the expiry of the 14 day period we will refund or re-credit you for any sum that has been paid by you or debited from your credit or debit card for the goods. In addition to the price you may be required to pay a delivery charge for the goods.

Delivery and Carriage

We will make reasonable endeavours to ensure your goods are dispatched to you as quickly as possible after placing your order.

If goods are 'in stock' we will dispatch your order as soon as possible or notify you if, for some reason, this is not possible. Please note that prescription glasses will take longer to dispatch, orders with prescription items can take up to 7 working days before dispatch. If the goods are 'available for order' we will obtain them from our suppliers and they will be dispatched within a week or we will notify you if, for some reason, this is not possible. 'Out of stock' goods are not currently available to order.

You will be notified by email at the time your goods are dispatched. Delivery of the goods will be made to the address provided by you at the time you placed your order. If your goods are not delivered safely within a reasonable number of days of you receiving notification of dispatch you should contact us. Customers should promptly inspect goods delivered to them to satisfy themselves that any goods delivered to them are as expected. In the case of non delivery if either The Optic Shop or our courier is at fault you will be offered the choice of a full refund or re-delivery.

Product Warranty

All goods supplied by us are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party use otherwise than as recommended by us or by failure to follow the Supplier´s instructions or any alteration or repair carried out without the Supplier´s approval.

If the goods supplied to you are damaged on delivery you should notify the Supplier in writing via e-mail sales@theopticshop.co.uk or phone 01656 858285 within 7 working days.

If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods you should notify the Supplier in writing via e-mail sales@theopticshop.co.uk or phone 01656 858285 as soon as possible but in any event within 14 days of the date you discovered or ought to have discovered the damage, defect or complaint.

Copyright and Trademarks

The site’s design names, text images, graphics, logo are all owned by or licensed to The Optic Shop. They may not be reproduced for any commercial or public purpose without the expressed consent of The Optic Shop.

The “The Optic Shop” name or any other registered or unregistered trademarks displayed on the site may not be used without the prior consent of The Optic Shop.

These Terms and Conditions of Sales should be read in conjunction with The Optic Shop Privacy Policy. Your statutory rights are not affected. For more information about your statutory rights please visit the Department of Trade and Industry’s Consumer Gateway website at: www.consumerdirect.gov.uk.

Your right to cancel

Under the United Kingdom’s Consumer Contracts Regulations you have the right to cancel the contract for the purchase at any point from the time of ordering until 14 working days after delivery.

If we have already shipped your order you will need to package the items and send them back to us in their original condition. Click returns policy for our procedure.

If we do not receive the item back from you we may arrange for collection of the item from your residence at your cost. We will refund the relevant part of the purchase price for that order as soon as possible and in any case within 30 days after we receive your notification.

Risk/Title

The goods are at your risk from the time of delivery.

Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) all sums due to us in respect of the goods and all other sums which are or which become due to us from you on any account.

We shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from us.

Promotional offers/gifts

Any promotional offers or gifts that are included with your order are subject to one per customer. If an order is returned the promotional item/gift must be returned, there will be a charge of the normal price of the item if not returned with the order.

Promotional discount voucher codes are not able to be applied to shipping costs. Only one code can be redeemed per order. Discount codes are not able to be redeemed on products within the already discounted Sale category.

Returned items that reduce a customers total final spend will reduce the discount given on applicable promotions.
